A checkbox on the cart page stops the customer who goes through the cart page. It does not stop the ones who never see it, and Shopify puts a buy-it-now button on the product page itself, with express wallet buttons alongside it, skipping the cart entirely. The thing that closes that gap is a cart and checkout validation function, which runs server side, explicitly covers express checkouts including the major wallets, and cannot be bypassed by customers. A checkbox alone is presentation; the validation is the enforcement.
On checkout itself, the picture is plan-dependent. Shopify's own extension documentation uses an "I agree to the terms and conditions" checkbox as its example, and notes that the component does not come with required validation built in. It also states that extensions on the information, shipping and payment steps are available only on the top plan, so for most stores the checkbox lives on the cart and the enforcement lives in the function.

- Test it rather than trusting the listing: put an item in the cart, use the buy-it-now button, and see whether anything asks you to agree. Every listing here claims compatibility, and this is the single feature the cheap builds get wrong.
- What ends up on the order
- Agreement is worth having only if it is recorded. The usual mechanism is a cart attribute, which carries over to the order and shows up in its additional details. Check what is stored, whether it includes a timestamp and which version of your terms was in force.
- How the text is written and translated
- The sentence beside the box is the agreement, so it should link to the real policy page and read as a sentence. If you sell in several languages, it has to exist in each of them.
- How much friction you are adding
